Jay owns copyright to the photo. Just because he gave AvWeb permission
to print it doesn't change that fact. If someone copies it off AvWeb and
uses it for anything other than his or her own private use, Jay could
(if willing to invest the resources) take them to court in a civil
action for infringement of that copyright.
Dave's statement is slightly naive. Copyright exists from the moment
of
creation. Registration is a different matter and, while helpful in a
courtroom, not required.
