"Must be" and "is" are not necessarily the same; there is no cross-check
at
the time the flight plan is filed.

Even if there were a cross-check that a pilot holds an instrument
rating, there's no practical way to cross-check whether the pilot is
instrument current.

instrument rated pilot.
