Yes, quite true. Any third party is just a bystander even if he is

A third party has no recourse to law for civil damages claimable by a
second party on the first.

Hummingbird, if any freeware author listened to you they would end up
pursuing imaginary rights which don't exist and they would end up
looking foolish and broke.

Why encourage that?
