A constructionist view of the Constitution is best for freedom. FROM THE 14TH AMENDMENT "...no state shall make or enforce any law which shall abridge the privileges or immunities of the United States nor shall any state deprive any citizen of life liberty or property without due process of law...." This is the constitution limiting state power. Take this away and state power is dramatically increased..
