The AOPA and Cong King [Republican] have asked the State
Department to get the American pilots released, at least
until after the civil investigation is completed.

IMHO, preliminary reports make it sound like a Brazilian
government screw-up with their communications network.

The big question is what happened to the transponder on the Embraer.

Mike,

The big question is what happened to the transponder on the Embraer.

Why? There are exactly zero reports on a transponder malfunction.

My guess, NOTHING.

The report says ATC had intermittent to missing PRIMARY returns
as well. PRIMARY returns are the skin paint from the radar. It
would seem that Brazillian RADAR just sucks badly. Nothing you
can do with the transponder will kill the primary return.

And a transponder just sits there unless it is triggered by
the secondary radar. If the ground based radar is inop or
intermittent, the transponder just does nothing.

....or it's triggered by another TCAS unit. TCAS goes around
probing transponders independently of the ground facilities.
