Stripped Long EZ airframe - buy it cheap or it goes to the landfill
Richard Riley wrote:
There's a stripped, formerly flying Long EZ for sale at KFUL. If he doesn't get a buyer by the end of the month he's going to cut it up and dump it. It's a good looking plane, workmanship ranges from good to very good. Pictures and more information are here. http://70.183.89.192/ad/index.php?a=2&b=467 He'd be happy with $10k. He might take less. If I were ready to cut it up and dump it, I'd be asking a lot less than $10K--or the $14K in the ad. In fact it would be better to _give_ it away to someone than to have to do the work to cut it up and carry it out, then clean up the hangar from the fiberglass sawdust. When he gets serious about getting rid of the thing, the price is going to go down quite a bit, or the saw is going to come out. Don W. |

Cutting it up would insulate him from future lawsuits; it's been done before for that very reason. |

Selling it as airplane parts would also do the same. If there are 10k worth of other parts betides the fuselage then maybe he'll get his price. Otherwise I'm sure he will chop it up before he gets that kind of money for it. Tony |

Usually it's because the owner has a very small penis. ANYONE can sue you for ANYTHING at ANY TIME. Nothing you can do about it. Homebuilders do not get sued for "product liability" generally because they have no product liability insurance. Unless they are Bill Gates they are a poor target. Whats the difference if he gets sued for liability when he gives the
project away or sells it, it's still in someone elses hands. That ought to be of great relief to those companies that make vacuum pumps, alternators, avionics, propellers, engines, and other airplane parts. Ron Wanttaja |

There's also the price at which it's just an insult. I figure it's worth about $15k, if he had time to leave it on the market. Feel free to offer him $20, but I don't think he'll take it. $8k, he might. He didn't build it. He bought it from someone else and hasn't worked on it if I read his add correctly. Since he paid $14K for it, you could argue that there is a market for it at that price. However, unless you are financially independent it is never an insult for someone to offer you their hard earned money for something you are about to discard. And for the posters who mentioned the potential for liability, see the first sentence. And anyway, I personally would not be interested even if it were given to me free, with free delivery, because my wife would kill me for taking on another project right now |

Anyone can sue you for anything. The best you can do is prepare yourself with enough documentation to discourage the other side from trying through a preponderance of evidence that shows the likelihood a judge won't side with them. Some people do that with documentation, others do it by showing there are no assets the lawyer can go for, and hence no money to get paid, and I'm sure there are tons of other ways. People who can't handle the slightest possibility of a lawsuit should prepare to destroy aircraft and lose their entire investment. It appears those are in the minority though. -- Posted via a free Usenet account from http://www.teranews.com |

Anyone can sue you for anything. To be accurate, almost anybody can file a suit for almost anything against anybody. Some number of filings, not an insignificant number, are rejected by clerks even before service--typically because no actual tort is alleged by the would-be plaintiff. There are a small number of people who, because of a previous record of abuse of process, are not even allowed to file without first obtaining specific permission from the court. That is not to say that there is no lawsuit abuse. But the remedies do exist in the law, they simply are underutilized. -- FF |

True, but most times the plaintiff turns around and files a revised lawsuit that takes care of that. Clerks do that all the time, making sure that the document has all the required components. That's part of their job. There are a small number of people who, because of a previous record of abuse of process, are not even allowed to file without first obtaining specific permission from the court. That's true too, but it's a very, very small number. That is not to say that there is no lawsuit abuse. But the remedies do exist in the law, they simply are underutilized. So true, but first you have to have a judge who isn't prejudiced towards his own, and actually believes that the system should not be abused.
