The state's Driver's Handbook makes no reference to a specific distance. Even if the statute does mention a certain distance, how did the officer measure it? From his line of sight, parallax discounts light poles and he couldn't easily distinguish the painted lines. I'll find out if he had video during discovery. He wasn't wearing his hat but their handbook now allows that the hat isn't a required part of the uniform. The handbook changed after they lost some cases over hatless officers. D. |
