I've got no problem with them trying to collect. I have a problem with their
rude behavior and threats. The check was not returned for insufficient funds
(NSF) it was returned because the account was closed.
I politely explained that the checkbook had been stolen, and that I had
closed the account. They told me that if I didn't provide a notorized
affidavit from the bank, they would press charges.
It's not my fault they accepted a stolen check. If they had bothered
checking, they would have found the account was closed before giving the
thief the merchandise. That's simply a risk they take when they accept
checks.
I'm not taking time off from work to go get paperwork from a bank because
they say so.
BTW, my wife is in court today testifying.
