There's no right to a speedy trial in NC. Under Spivey the
prosecution can take years before they actually go to trial. Henry
Spivey sat in jail for 4 1/2 years without a trial, and the NC Supreme
Court said that was not a violation of his 6th amendment rights
because "the courts were crowded".
If the court is unable to meet its Constitutional obligations, the
defendant has ground for dismissal for lack of prosecution (unless
he's waived time).
