Some states allow anyone who claims that they are a contractor to be treated as one, but some others get downright nasty. State labor regulators? I'd be a lot more concerned about the IRS. A few years ago they started cracking down on employers who claimed their employees were independent contractors, in order to avoid payroll taxes.
