[x-posting deleted] Chris E wrote: Similarily the 1st amendment provides right to free speech to make remarks about all kinds of issues, not just certain issues that some folks feel ok. So then walk into a crowded theater and shout "fire". Then let's check your right to free speech again. :-) It would be legitimate speech if there really were a fire. Yelling "Fire!" in a crowded theater, however, has no value in communication other than to cause a stampede and probable violence and personal injury. Unless, of course, there's a fire. Let's take the example of students mooning a deputy sheriff in NC. They were arrested, charged, and convicted. The judge who sentenced them said in opposition to their argument of free speech that there were exceptions and this was one. But on appeal the higher court overruled the trial court and stated that the students could not be tried under any criminal theory, including indecent exposure. #m -- Buck Fush! ---- Oh, wouldn't I like to Blush Fush. |
