And it is an intentional violation that is excepted from the protection of submitting the form (which is, I think, the point you are making?). I'm too lazy to go look at the exact wording now, but I wouldn't be surprised if there's some language in the other exceptions that would have disallowed this particular violation, given how egregious it was.
